Family members of EU/EEA citizens

Last updated: 02.05.2011 // A citizen of an EU/EEA country may stay and work in Norway without a permit for up to three months from his/her arrival in the country. If the individual resides longer in Norway, he/she shall register his/her right to residency at the nearest Police Station. Residency in another Nordic country is not deducted from the residency period. The same applies to members of the family to an EU/EEA citizen who are also EU/EEA nationals. Family members who are not EU/EEA nationals must have a valid passport and be able to document that they are a member of your household or that they are supported by you.

Immediate family members of an EU/EEA citizen are:

·         Spouse or co-habiting partner. There are no requirements for financial support and accommodation.

·         Cohabitant. Both of you must be over 18 years of age, have lived together in a permanent and established cohabitation relationship for at least two years and intend to continue living together in Norway. Neither of you can be married to other people. There are no requirements for financial support and accommodation.

·         Cohabitant who has or is expecting a child with the person in Norway, although you have not lived together for two years. 

·         Children, grandchildren etc. under the age of 21. There are no requirements for financial support and accommodation.

·         Children, grandchildren etc. over the age of 21 when they are supported by you

·         Parents, grandparents etc. when they are supported by you. The person in Norway cannot be a student.

·         Persons who will get married in Norway with an EU/EEA citizen with right of residence. The fiancé’s right of residence is only valid for 6 months and it must be likely that marriage will be entered into in this period.  

Subject to a visa requirement
You as a Ukrainian, Belarusian or Moldavian are subject to a visa requirement. Therefore you must hold a valid visa when entering Norway. If you do not already have one, you need to apply for one. You register your visa application online through our Application Portal. Here you may also make an appointment to deliver relevant documents to the Norwegian Embassy in Kiev. Or you may call the Visa Section during our telephone hours every working day between 14.00-15.00, Tel: +380 44 281 22 00 / +47 23 95 57 00. You may also after registration on our Application Portal, come to the Embassy every working day between 10.00-12.00, and we will receive your visa application as soon as possible.

Please be aware that spouses, children and dependant ascendants of all EU//EEA nationals are exempted from a visa fee. The fee you have paid on our Application Portal will therefore be reimbursed at the Embassy after you have presented documentation proving relationship to an EU/EEA national. Stepchildren of EU/EEA citizens are not exempted from visa fee.

You can choose if you at the same time as you apply for a visa in order to enter Norway, apply for a residence card. If not, you may apply for a residence card after you entered Norway, within 3 months after you entry.

Family immigration with an EU/EEA national if you are a citizen of a country outside the EU/EEA
Immediate family members of EU/EEA citizens (who are citizens of countries outside EU/EEA, may reside in Norway if their residence is based on the rights of a citizen of EU/EEA country residing in Norway. You do not need to apply for a work permit in this case.

Residency card (oppholdskort)
If you would like to stay for longer than three months in Norway, you should however apply for a residence card.

As a rule, family members of EU/EEA nationals are included in the registration requirement for EU/EEA  nationals (registration certificate). However, some people must still apply for a residence card as a member of an EU/EEA national's family, or apply for family immigration pursuant to the general regulations (residence permit).

You can apply for a residence card as a family member pursuant to the EU/EEA regulations if the person you are applying for family immigration with has right of residence pursuant to the EU/EEA regulations. If he or she has a permanent residence permit (settlement permit), you can apply pursuant to the general regulations. If the person you are applying for family immigration with has a permit pursuant to the general regulations, you must apply pursuant to the general regulations.

Where can you apply
An application for residence card is registered as an application for family immigration online on our Application Portal. You may register your application independent of opening hours, make an appointment to deliver relevant documents to the appropriate Police station or Norwegian Embassy/Consulate without having to wait in line, and you can pay the application fees online. The application is formally registered on the date you submit your passport with relevant supporting documentation. We will then start the processing of your application. (You may nominate a person in Norway to register an application on your behalf. However, you are responsible for the application and have to hand in the supporting documentation yourself.) The application should be submitted to your nearest VFS application centre (See link to the right) after the online registration.

What must be enclosed with the application? 

  • Cover letter you received as confirmation on your e-mail[1](PDF attachment) after you registered your application and booked time for submitting documents at Application Portal
  • Passport photo not older than three months
  • Passport and copy of used pages. Please be aware that there should be at least two free pages marked “ВІЗИ / VISAS”. If children included in passport and application – extra two free pages needed for each child.
  • A copy of a valid passport
  • Documentation of the family relationship (e.g. birth certificates of children, marriage certificates of spouses, documentation of partnership, transcript from population register, joint rent contracts/purchase contracts, joint loans etc. with a cohabitant, documentation of cohabitants expecting or having children together).
  • Documentation that the person you are applying for family reunification with has right of residence pursuant to the EU/EEA regulations (registration certificate or other documentation).
  • Documentation that you are supported, if you are:

        - child or grandchild over the age of 21.

        - parent or grandparent of the sponsor or the sponsor’s
          spouse/partner or cohabitant.

        - other family members who have no other family in their
          home country and who are members of the EU/EEA  national’s
          household and are supported by him/her, or family members
          with serious health problems who can only be cared for by
          the sponsor.

 

You must show the original documents of the above documentation when you submit your application.

If the person whom you are applying for family immigration with is here as a student or has right of residence on the basis of sufficient funds (own funds or permanent periodical benefits), you must enclose a declaration from the sponsor in your application stating that he/she will finance your stay in Norway. The person who lives in Norway must also have health insurance (e.g. European health insurance card).

If you are applying for a residence card as a child, and only one of your parents is to live in Norway, you must enclose the written consent of the other parent. If not, you must submit either a court order or a birth certificate showing that the parent in Norway has sole care and control for you.

If you are engaged to an EU/EEA citizen and applying for a residence card, you must submit documentation that the person in Norway can support you financially. You also need a medical insurance that covers expenses in connection with repatriation for medical reasons, necessary medical treatment and hospital treatment. The condition of health insurance is satisfied if you have proof of private health insurance.
